These Terms of Service ("Terms") govern your access to and use of the Brickato platform, including our website, applications, and AI-powered construction document analysis services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Services, you agree to these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use our Services.

2. Service Description

Brickato provides an AI-powered platform for construction document analysis. Our Services include:

• Document upload and storage for construction project files.

• OCR processing to extract text from scanned and digital documents.

• AI-powered question answering with citations from your documents.

• Organization profile management for company information.

• Project workspace management for organizing documents by project.

3. Account Terms

To use our Services, you must:

• Be at least 18 years old.

• Provide accurate and complete registration information.

• Maintain the security of your account credentials.

• Notify us immediately of any unauthorized access to your account.

• Be responsible for all activities that occur under your account.

4. User Content and Ownership

You retain all ownership rights to the documents and content you upload to our platform ("User Content"). By uploading User Content, you grant Brickato a limited, non-exclusive license to: Process, store, and analyze your documents to provide the Services. Generate embeddings and metadata from your content. Use your content to generate AI responses to your queries. This license is solely for the purpose of providing the Services and expires when you delete your content or account. We do not claim ownership of your User Content.

5. Acceptable Use

You agree not to use our Services to:

• Upload content that infringes intellectual property rights or violates any law.

• Upload malware, viruses, or other harmful code.

• Attempt to gain unauthorized access to our systems or other users' accounts.

• Use the Services for any illegal purpose or to facilitate illegal activities.

• Reverse engineer, decompile, or attempt to extract our source code.

• Overwhelm our systems with excessive requests or automated access.

• Misrepresent your identity or affiliation with any person or entity.

• Upload content containing sensitive personal data of third parties without proper consent.

6. AI-Generated Content Disclaimer

IMPORTANT: Our AI-powered features generate responses based on analysis of your uploaded documents. While we strive for accuracy, AI-generated content: May contain errors, inaccuracies, or misinterpretations. Should not be relied upon as legal, financial, or professional advice. Should be verified against source documents before making business decisions. May not capture all relevant information from your documents. You are responsible for reviewing and verifying all AI-generated responses. Brickato is not liable for decisions made based on AI-generated content.

7. Subscription and Payment

Our Services are offered through subscription plans: Free Tier: Limited features with usage restrictions. Paid Plans: Monthly or annual subscriptions with expanded features. For paid subscriptions: Payment is due at the beginning of each billing period. Subscriptions automatically renew unless cancelled. We may change pricing with 30 days notice to existing subscribers.

8. Refund Policy

All paid subscriptions come with a 30-day money-back guarantee. If you are not satisfied with our Services for any reason, you may request a full refund within 30 days of your purchase date. To request a refund, contact us at support@brickato.com with your account details. Refund requests are processed within 5-10 business days. After the 30-day refund period, you may cancel your subscription at any time. Upon cancellation, you will retain access to the Services until the end of your current billing period, but no refunds will be provided for the remaining period.

9. Intellectual Property

The Brickato platform, including its software, design, logos, and documentation, is owned by Brickato and protected by intellectual property laws. You may not: Copy, modify, or distribute our platform or its components. Use our trademarks without prior written permission. Remove any copyright or proprietary notices from our materials. All rights not expressly granted are reserved by Brickato.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: BRICKATO PROVIDES THE SERVICES "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Brickato, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: Your use of the Services. Your User Content. Your violation of these Terms. Your violation of any third-party rights.

12. Termination

You may terminate your account at any time through your account settings. Upon termination: Your access to the Services will be immediately revoked. Your User Content will be deleted within 30 days. Refunds upon termination are subject to our Refund Policy (Section 8). We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.

13. Governing Law and Jurisdiction

These Terms are governed by applicable law, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved exclusively in the courts of the applicable jurisdiction. You agree to submit to the personal jurisdiction of these courts and waive any objections based on venue or inconvenient forum.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services and terminate your account.
